By purchasing, downloading, installing or launching any software made by TXL20 Production Tools, you agree to our EULA:
TXL20 PRODUCTION TOOLS
Section 1: Preamble
(1) The following terms and conditions apply to all legal transactions between TXL20 Production Tools (hereinafter “TXL20”) and their contracting parties regarding the sale and use of the software offered by TXL20.
(2) Deliveries, services, and offers of TXL20 will exclusively be based on these terms and conditions. These terms and conditions are valid for the current business relationship – even without them being explicitly referred to again – for all future orders, offers, deliveries, and services of TXL20. Any terms and conditions of the customer that deviate from these terms shall not be acknowledged. Deviating agreements between the contracting parties must be in writing to be effective.
Section 2: Usage Rights
(1) Customers may download and install the software on any device they want but can only authorize and therefore use an unlocked version of the product on a number of authorized devices. The number of authorizations, or ‘seats,’ is indicated for each product. An authorization is device-based and cannot be deactivated unless explicitly stated otherwise on the product page. If more seats are required, customers may purchase additional ones.
(2) Transferring the software to a third party is strictly prohibited. The software license is non-transferable, and the customer may not sublicense, sell, or share their license with any third party.
(3) Customers are encouraged to try the software using the available trial or demo mode before making a purchase. All purchases are final, and no refunds will be issued.
Section 3: Warranty and Liability
(1) The software is provided on an “as-is” basis. To the maximum extent permitted by applicable law, TXL20 disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. TXL20 does not warrant that the software will meet your requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected.
(2) Limitation of Liability:
(a) To the maximum extent permitted by applicable law, TXL20 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with the use or inability to use the software, even if TXL20 has been advised of the possibility of such damages.
(b) In no event shall TXL20’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the software.
Section 4: Refund/Cancellation Policy
(1) No refunds: Due to the availability of trial and demo versions of the software, all purchases are final. Once a license has been purchased, it cannot be canceled, refunded, or transferred.
(2) In the event of a technical issue preventing software activation or use, TXL20 will provide assistance to resolve the issue but is not obligated to provide a refund. Refunds may be issued if required by law in certain jurisdictions.
Section 5: Data Protection (Privacy Policy)
(1) TXL20 undertakes to comply with all applicable data protection regulations. Personal data will be collected and processed exclusively for the purposes of fulfilling contractual obligations, including software delivery, license management, and customer support.
(2) Personal data collected includes but is not limited to:
Name and contact information (email)
Payment details (processed securely via third-party services)
Device and usage information (for license management)
(3) The customer has the right to access, correct, or delete their personal data upon request by contacting info@txl20.com.
(4) TXL20 will not share personal data with third parties unless required by law.
Section 6: Miscellaneous
(1) Changes to this EULA: TXL20 reserves the right to update or amend this EULA at any time. The version of the EULA in effect at the time of download, installation, or purchase of the software will apply to the user. Continued use of the software after such changes constitutes acceptance of the updated terms.
(2) Written form requirement: Any changes and amendments to this agreement must be made in writing. The written form requirement can only be waived through a written declaration.
